| | | Be it enacted by the People of the State of Maine as follows: |

| | | Sec. 1. 5 MRSA §1825-B, sub-§12 is enacted to read: |

| | | 12.__Persons prohibited from bidding.__Notwithstanding any | | other provision of this chapter, a person is prohibited from | | participating in competitive bidding under this chapter if: |
|
| | | A.__Within the 3-year period immediately preceding a bid, | | the person was found to be in violation of any state law; or |
|
| | | B.__On the date of the bidding deadline, the person is in | | consent agreement negotiations with the State. |
|
| | | This bill excludes from the state bidding, award and contract | | process persons who have been found to be in violation of state | | law or who are in consent agreement negotiations with the State. |
