Sec. 1. 12 MRSA §11224 is enacted to read:

§11224. Shooting at or near wild turkey decoys

1.__Shoot or shoot at decoy.__A person may not with a firearm, a bow and arrow or a cross bow shoot or shoot at a wild turkey decoy of another person.

A. A person who violates this subsection commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.

B. A person who violates this subsection after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime.

2.__Shoot within area of another person's decoys.__A person may not with a firearm, a bow and arrow or a crossbow shoot within an area encompassed by a set of another person's wild turkey decoys, including the area 50 yards away from the outer perimeter of the set of decoys.

A. A person who violates this subsection commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.

B. A person who violates this subsection after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime.

SUMMARY

This bill prohibits the shooting at or near wild turkey decoys with a firearm, a bow and arrow or a crossbow and establishes penalties for violations.
