| | | Sec. 1. 19-A MRSA §4011, sub-§5 is enacted to read: |

| | | 5.__Defense.__It is a defense to a violation under subsection | | 1 when the conduct alleged is nonphysical contact or | | communication that the plaintiff willfully initiated the | | nonphysical contact or communication. |

| | | This bill provides as a defense to a violation of a protection | | from abuse order when nonphysical contact or communication is | | alleged that the plaintiff initiated the nonphysical contact or | | communication. |
