Sec. 1. 32 MRSA §13065, sub-§3-A is enacted to read:

3-A.__Water test disclosure.__The commission shall adopt rules regarding minimum standards of practice for water test disclosure to ensure consistency with the requirements of Title 33, section 173.__Rules adopted pursuant to this subsection are routine technical rules as defined in Title 5, chapter 375, subchapter 2- A.

Sec. 2. 33 MRSA §173, sub-§1, ¶D, as enacted by PL 1999, c. 476, §1, is amended to read:

D. The date of the most recent water test, if any in accordance with subsection 1-A; and

Sec. 3. 33 MRSA §173, sub-§1-A is enacted to read:

1-A.__Water test results.__If the property has a private water supply, the results of a water test, performed by a state- certified laboratory, that tests the following:

A.__Coliform bacteria;

B.__Nitrate and nitrite nitrogen;

C.__Fluoride;

D.__Chloride;

E.__Hardness;

F.__Copper;

G.__Iron;

H.__pH;

I.__Manganese;

J.__Uranium;

K.__Arsenic;

L.__Color;

M.__Turbidity;

N.__Odor;
