Sec. 1. 22 MRSA §3174-GG is enacted to read:

§3174-GG.__Children's orthodontic coverage

Beginning January 1, 2006, the MaineCare program may provide orthodontic coverage for a child only as required to correct a birth defect or a debilitating syndrome and as required by the federal Department of Health and Human Services, Centers for Medicare and Medicaid Services.__The department shall adopt rules to implement this section.__Rules adopted pursuant to this section are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A.

SUMMARY

This bill provides that, beginning January 1, 2006, the MaineCare program may provide orthodontic coverage for children only as required to correct birth defects and debilitating syndromes and as required by the federal Department of Health and Human Services, Centers for Medicare and Medicaid Services. The bill directs the department to adopt implementing rules, which are designated routine technical rules.
