Sec. 1. 25 MRSA §3503-B is enacted to read:

§3503-B.__Bicycle distribution

Notwithstanding Title 33, chapter 41 and pursuant to a municipal ordinance authorizing such disposition,__a police department or law enforcement agency may distribute bicycles that are abandoned according to the procedures of this chapter to charitable organizations that primarily benefit children.__ The disposition of abandoned bicycles according to this section triggers no obligations or responsibilities on the part of the distributing municipality that might otherwise be required by Title 33, chapter 41.

SUMMARY

This bill allows a municipality to adopt an ordinance that allows for the donation of abandoned bicycles to a charitable organization rather than sending the proceeds from the sale of the property to the State Treasurer according to abandoned property law.
