| | | Be it enacted by the People of the State of Maine as follows: |

| | | Sec. 1. 17-A MRSA §558 is enacted to read: |

| | | 1.__A person is guilty of adultery if the person engages in a | | sexual act with a person who is not the actor's spouse and: |
|
| | | A.__The actor is married; or |
|
| | | B.__The actor is not married and knows that the other person | | involved in the act is married. |
|
| | | 2.__Adultery is a Class D crime. |
|
| | | This bill makes adultery a Class D crime. Adultery is defined | | as engaging in a sexual act with a person not the actor's spouse | | when either the actor is married, or the actor is not married and | | knows the other person is married. |
