| | | Each fireworks technician license and fireworks technician | | assistant license is valid for a term of one year.__Unless | | revoked or suspended, the license is renewable annually. |

| | | §235.__Denial; suspension; revocation; grounds |

| | | The commissioner may, after a hearing in conformance with | | applicable provisions of the Maine Administrative Procedure Act, | | suspend or revoke a license issued under this chapter.__The | | following are grounds for denial, suspension or revocation of a | | license: |

| | | 1.__Fraud or deceit.__The practice of fraud or deceit in | | obtaining a license under this chapter or in the performance of | | services within the scope of the license issued; |
|
| | | 2.__Conviction of certain crimes.__Conviction of a crime that | | relates directly to the practice for which the person is licensed | | or conviction of any crime for which incarceration for one year | | or more may be imposed; |
|
| | | 3.__Violation of chapter or rule.__Any violation of this | | chapter or any rule adopted by the commissioner; |
|
| | | 4.__Aiding or abetting unlicensed practice.__Aiding or | | abetting the practice of displaying or discharging fireworks by a | | person not duly licensed under this chapter and who is | | represented as duly licensed; or |
|
| | | 5.__Incompetence.__Incompetence in the practice of displaying | | or discharging fireworks.__A licensee is considered incompetent | | in the practice if the licensee has: |
|
| | | A.__Engaged in professional conduct that evidences a lack of | | ability or fitness to perform the duties for which that | | licensee is licensed; or |
|
| | | B.__Engaged in professional conduct that evidences a lack of | | knowledge of, or inability to apply, appropriate principles | | or skills to carry out the practice for which that licensee | | is licensed. |
