| | | Sec. 1. 10 MRSA §1676, sub-§5 is enacted to read: |

| | | 5.__De facto concentration.__Whenever a refiner becomes the | | single or majority source of motor fuel supply within the State, | | the State shall limit the control of the refiner of the retail | | market for motor fuels by eliminating the anti-competitive | | situation. |

| | | This bill amends the Petroleum Market Share Act to ensure fair | | competition among Maine's petroleum marketers by requiring the | | State to eliminate anti-competitive situations. |
