| | | Sec. 1. 22 MRSA §1580-E is enacted to read: |

| | | §1580-E.__Smoking prohibited in motor vehicles with children |
|
| | | 1.__Definitions.__As used in this section, unless the context | | otherwise indicates, the following terms have the following | | meanings. |
|
| | | A.__"Child" means a person under 18 years of age. |
|
| | | B.__"Smoking" means carrying or having in one's possession a | | lighted cigarette, cigar, pipe or other object giving off | | smoke or containing any substance giving off smoke. |
|
| | | 2.__Smoking prohibited.__A person may not smoke tobacco or any | | other substance in a motor vehicle when a child is in the motor | | vehicle. |
|
| | | 3.__Violation.__A person who smokes in a motor vehicle when a | | child is in the motor vehicle commits a civil violation for which | | a forfeiture of not more than $100 may be adjudged. |
|
| | | This bill prohibits smoking in a motor vehicle when children | | are in the motor vehicle. |
