1.__Extremely hazardous substances used.__Facilities subject
to reporting requirements for extremely hazardous substances
under the SARA, Title III, Section 312;

 
2.__Released toxics.__Facilities required to report under the
SARA, Title III, Section 313; and

 
3.__Hazardous waste generated.__Facilities that generate 100
kilograms or more of hazardous waste in a calendar month for more
than 3 months of the year.

 
§2304-B.__Exemptions

 
1.__Exempt facilities.__The following facilities are exempt
from the planning, reporting and fee requirements of this
chapter:

 
A.__Drinking water supply treatment facilities;

 
B.__Municipal wastewater treatment facilities;

 
C.__Wholesale distributors of chemicals;

 
D.__Hazardous substance transporters;

 
E.__Retail and wholesale distribution facilities of motor
fuel, aviation fuel, heating oil or other refined petroleum
products;

 
F.__Pesticide distribution and application activities
regulated by the Board of Pesticides Control;

 
G.__Commercial hazardous waste treatment or storage
facilities;

 
H.__For purposes of the planning, reporting and fee
requirements relating to hazardous waste generation only,
pilot plants or pilot production units;

 
I.__Hazardous waste transporters;

 
J.__Hazardous waste generated as a result of remedial or
corrective actions or facility closures required by law or
undertaken to protect employee health and safety, public
health and safety or the environment; and

 
K.__Households.

 
2.__Exempt chemicals.__The following chemicals, when released
in the context specified in this subsection, are exempt from the
planning, reporting, and fee requirements of this chapter:
