| | | Be it enacted by the People of the State of Maine as follows: |

| | | Sec. 1. 7 MRSA §4201, sub-§6, as enacted by PL 1997, c. 642, §2, is | | amended to read: |

| | | 6. Regulated residual. "Regulated residual" means a residual | | regulated by the Department of Environmental Protection pursuant | | to Title 38, chapter 13, the use and storage of which has been | | determined by the department to require a nutrient management | | plan. |

| | | Current law requires a farm that stores or utilizes by- | | products of a nonagricultural production or treatment process | | that are regulated by the Department of Environmental Protection | | to file a nutrient management plan with the Commissioner of | | Agriculture, Food and Rural Resources. |
|
| | | This bill requires a plan to be filed only if the Department | | of Agriculture, Food and Rural Resources determines that the by- | | product needs a nutrient management plan. |
