An Act To Amend the Laws Pertaining to Improvident Transfers

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 33 MRSA §1021, sub-§2,  as enacted by PL 1987, c. 699, §1, is amended to read:

2. Elderly person.   "Elderly person" means a person who is 60 65 years of age or older.

This bill increases from 60 years of age to 65 years of age the earliest age at which a person who is dependent on others must be represented by independent counsel to avoid a presumption of undue influence when that person transfers real or personal property or money for less than full consideration or execution of a guaranty.
