An Act To Amend the Laws Governing Mechanics Liens
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 10 MRSA §3252 is amended to read:
§ 3252. Prevention of lien
If the labor, materials or services underlying a lien pursuant to this chapter were not furnished by under a written contract by or with the consent of the owner of the property affected, the owner may prevent such lien for labor, materials or services not then performed or furnished, by giving written notice to the person performing or furnishing the same that he will not be responsible therefor the lien may not be enforced.

This bill requires that for a lien for construction costs to be enforced, it must be for labor, materials or services performed under a written contract.
