Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 29-A MRSA §101, sub-§46-A is enacted to read:

 
46-A. Nonimmigrant. "Nonimmigrant" means a Maine resident who
is not a citizen or lawful permanent resident of the United
States.

 
Sec. 2. 29-A MRSA §1301, sub-§10 is enacted to read:

 
10. Nonimmigrant applicants. An applicant for a license who
is a nonimmigrant must present to the Secretary of State at each
application written proof, evidence or documentation that the
applicant's presence in the United States is authorized under
federal law.

 
Sec. 3. 29-A MRSA §1401, sub-§9 is enacted to read:

 
9. Nonimmigrant applicants. An applicant for a license who is
a nonimmigrant must present to the Secretary of State at each
application written proof, evidence or documentation that the
applicant's presence in the United States is authorized under
federal law.

 
Sec. 4. 29-A MRSA §1405, sub-§1, as enacted by PL 1993, c. 683, Pt. A,
§2 and affected by Pt. B, §5, is amended to read:

 
1. Lost or destroyed licenses, registration certificates,
instruction permits and nondriver identification cards. If a
license, registration certificate or, instruction permit or
nondriver identification card is lost or destroyed, a person may
obtain a duplicate upon furnishing proof of loss or destruction.

 
Sec. 5. 29-A MRSA §1405, sub-§3, as amended by PL 2003, c. 434, §21
and affected by §37, is further amended to read:

 
3. Fee. The fee for a duplicate registration certificate and
instruction permit is $2. The fee for a duplicate license or
nondriver identification card is $5.

 
Sec. 6. 29-A MRSA §1405, sub-§5 is enacted to read:

 
5. Nonimmigrant applicants.__An applicant for a duplicate
license or nondriver identification card who is a nonimmigrant
must present to the Secretary of State at each application
written proof, evidence or documentation that the applicant's
continued presence in the United States is authorized under
federal law.

 
Sec. 7. 29-A MRSA §1406, sub-§2-A is enacted to read:
