An Act To Amend the Charter of the Long Pond Water District

Emergency preamble. Whereas,  acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and

Whereas,  uninterrupted collection and distribution of water is essential to the health and welfare of the inhabitants of the Town of Sullivan and the Town of Sorrento; and

Whereas,  in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,

Be it enacted by the People of the State of Maine as follows:

Sec. 1. P&SL 1989, c. 121, §1  is repealed and the following enacted in its place:

Sec. 1. Territorial limits; corporate name; purposes. The inhabitants and territory of those parts of the Town of Sullivan and the Town of Sorrento described as follows, constitute a quasi-municipal corporation under the name of "Long Pond Water District" for the purpose of supplying the inhabitants and others of the district with pure water for domestic, sanitary, commercial, industrial, agricultural and municipal purposes: beginning at a point 68º12'23.14" W, 44º32'26.13" N, in Sullivan; thence east to the Sullivan/T7 SD border; thence following the border in a southeasterly direction to the Sullivan/T7 SD/Gouldsboro border; thence in a southwesterly direction to Flanders Bay; thence in a northwesterly direction along the coast of Flanders Bay to the southwest corner of the Sullivan/Sorrento border; thence around Sorrento on the coast of Flanders Bay to the northwest corner of the Sullivan/Sorrento border; thence in a northwesterly direction to a point along the coast 68º12'23.14" W, 44º31'14.48" N; thence north to the point of beginning.

Sec. 2. P&SL 1989, c. 121, §9, first ¶  is amended to read:

Sec. 9. Trustees; how elected; first board; meeting; officers. All of the affairs of the district must be are managed by a board of trustees composed of 5 members, 4 3 of whom are residents of Sorrento and one 2 of whom is a resident are residents of Sullivan and who are, after selection of the first board, elected as provided in the Maine Revised Statutes, Title 35-A, chapter 63 64.

Sec. 3. Transition; trustees in office. Trustees of the Long Pond Water District in office on the effective date of this Act may continue in office for the remainder of their terms. When the term of office of a trustee expires, that trustee’s successor is elected in accordance with Private and Special Law 1989, chapter 121, section 9, as amended by this Act.

Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.

Effective April 9, 2007.
