     Sec. B-1. Adoption of rules. The major substantive rules adopting the unified eligibility provisions for early childhood special education and other special education programs for eligible persons from birth to 20 years of age, pursuant to the Maine Revised Statutes, Title 20-A, section 7005, subsection 1, must be presented by the Department of Education for legislative review in the First Regular Session of the 123rd Legislature, except that the Commissioner of Education may adopt a rule for the unified eligibility provisions for early childhood special education and other special education programs for eligible persons from birth to 20 years of age for the state fiscal year 2006-07 as an emergency rule pursuant to Title 5, section 8073. Notwithstanding Title 5, section 8052, subsection 1, the Department of Education must hold a public hearing on the emergency, major substantive rule adopted pursuant to this section. The commissioner shall report to the joint standing committee of the Legislature having jurisdiction over education and cultural affairs by February 15, 2007 on the emergency, major substantive rule established for fiscal year 2006-07.
