Amend the amendment in Part C by striking out all of section 13 and inserting the following:

Sec. C-13. Maine Clean Election Fund transfers. Notwithstanding any other provision of law to the contrary, the State Controller shall transfer $3,000,000 from the Maine Clean Election Fund to the unappropriated surplus of the General Fund no later than 10 days following the effective date of this section. Notwithstanding any other provision of law to the contrary, the State Controller, in accordance with the Maine Revised Statutes, Title 21-A, section 1124, subsection 2, paragraph B, shall transfer $3,000,000 from the taxes imposed under Title 36, Parts 3 and 8 and credited to the General Fund to the Maine Clean Election Fund on or before January 1, 2019.

SUMMARY

This amendment replaces the section of the committee amendment allocating funds to the Maine Clean Election Fund. Instead, this amendment requires the State Controller to:

1. Transfer $3,000,000 from the Maine Clean Election Fund to the General Fund within 10 days of enactment; and

2. Transfer, as required by statute, $3,000,000 into the Maine Clean Election Fund by January 1, 2019.

The amendment also provides for an allocation of funds in fiscal year 2017-18 to offset an error in Public Law 2017, chapter 284 that resulted in a negative allocation of funds in fiscal year 2018-19.
