The bill shifts the administration of the returnable beverage container program from the Department of Agriculture, Conservation and Forestry (ACF) to the Department of Environmental Protection (DEP). This bill allows DEP to enter into a memorandum of understanding regarding the administration of this program. DEP and ACF have indicated that a memorandum of understanding will be prepared allowing ACF inspectors to continue certain inspections. This program generates an average yearly Other Special Revenue Funds revenue of $224,874 to ACF that will now go to DEP. There will be transfers of $212,809 in fiscal year 2015-16 and $217,462 in fiscal year 2016-17 from DEP to ACF to reimburse ACF for continuing to undertake inspection services.
