An Act To Establish a Committee To Promote General Aviation in the State

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 5 MRSA §12004-K, sub-§12-A  is enacted to read:

Sec. 2. 6 MRSA §3, first ¶,  as amended by PL 1979, c. 541, Pt. A, §42, is further amended to read:

As used in this chapter and chapters 2 to 17 Title, unless the context otherwise indicates, the following terms shall have the following meanings.

CHAPTER 19

AVIATION ADVISORY COMMITTEE

§ 401 Aviation Advisory Committee established

The Aviation Advisory Committee, referred to in this chapter as "the committee" and established by Title 5, section 12004-K, subsection 12-A, is established to advise and assist the department in developing and maintaining general aviation and airports in the State.

§ 402 Membership

The committee consists of at least 6 but no more than 10 members appointed by the Governor. A member must have 5 years of experience as a pilot, an airport facility manager or a fixed base operator. The terms of the members are for 3 years. The Governor shall fill a vacancy in the membership for an unexpired term. A vacancy must be filled in the same manner as the original appointment.

§ 403 Meetings

The committee shall annually elect a chair from among its members, and the chair serves a term of one year. The committee shall meet at the call of the chair or at the call of at least 3 members of the committee. The committee shall meet at least 3 times a year.

§ 404 Staff support

The department shall supply reasonable staff support as requested by the committee.

§ 405 Rules.

The committee may adopt rules to govern the operations of the committee. Rules adopted pursuant to this section are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A.

Sec. 4. Staggered terms for initial appointees. Notwithstanding the Maine Revised Statutes, Title 6, section 402, the terms of the initial members of the Aviation Advisory Committee must be staggered. Of the initial appointees, at least 2 members are appointed for terms of 3 years, at least 2 members for terms of 2 years and at least 2 members for terms of one year.

This bill establishes in the Maine Revised Statutes a committee to aid the Department of Transportation in developing and maintaining general aviation and airports in the State.
