An Act To Amend the Charter of the Buckfield Village Corporation

Be it enacted by the People of the State of Maine as follows:

Sec. 1. Territory. The inhabitants of and the territory within that part of the Town of Buckfield described as follows constitute a standard district under the name of the Buckfield Village Water District, referred to in this Act as "the district," for the purpose of supplying the district and the inhabitants of the district with pure water for domestic, commercial, sanitary, industrial, agricultural and municipal purposes: Tax Map 6, Lot 1, Parcel 14; Lot 2, Parcels 1 and 2; Lot 3, Parcels 3, 5, 27, 27.1, 28, 31, 32, 35 and 35.1; Lot 4, Parcels 1, 2 and 3; Tax Map 7, Lot 4, Parcels 11, 12 and 21; Tax Map 12, Lot 1, Parcels 1, 2, 2.1, 3, 3.1, 4, 4.1, 4.2, 5, 6, 7, 8, 9, 9.1, 11, 12, 13, 14, 15, 16, 17 and 2A; Lot 2, Parcels 2, 5, 6, 7, 7.1, 8, 9, 9.1 and 9.2; Lot 3, Parcels 2, 4, 5, 6.1, 6.10, 6.11, 6.12, 6.13, 6.14, 6.2, 6.3, 6.4, 6.5, 6.6, 6.7, 6.8 and 6.9; Lot 4, Parcels 3, 3.2, 6, 7 and 8; Lot 8, Parcels 6.1, 7, 8, 9, 10, 12, 14, 15, 16, 17, 18, 18.1, 18.3, 20 and 8A; Lot 9, Parcels 1, 1.1, 1.2, 1.3, 1.6, 2, 3, 4, 5, 6, 7 and 11; Lot 10, Parcels 1 and 1B; all of Tax Map 13; and all of Tax Map 14.

Sec. 2. Powers; authority; duties. The district has all the powers and authority and is subject to all the requirements and restrictions provided in the Maine Revised Statutes, Title 35-A, chapter 64, except as otherwise provided in this Act.

Sec. 3. Additional powers. The district is authorized to provide service to customers in the Town of Buckfield outside the territory described in section 1.

Sec. 4. Power to take water. The district is authorized to take, to hold and to convey within the Town of Buckfield and from any part of the town water from any surface water or groundwater source within the town.

Sec. 5. Number of trustees. All of the affairs of the district are managed by a board of trustees composed of 3 members, 2 of whom shall serve 3-year terms, must reside within the territory of the district and are elected by a plurality vote at the annual meeting of the district. One member is appointed by the selectpersons of the Town of Buckfield for a one-year term and must be a resident of the Town of Buckfield.

Sec. 6. Vacancy. When the term of office of an elected trustee expires, the trustee's successor must be elected by a plurality vote by the inhabitants of the district. The trustee elected serves the full term of 3 years. If a vacancy arises in the elected membership of the board of trustees, the vacancy must be filled for the unexpired term by a special election to be called by the trustees, upon 24 days' notice. If a vacancy arises in the appointed membership of the board of trustees, the selectpersons of the Town of Buckfield shall make an appointment for the unexpired term within 60 days.

Sec. 7. P&SL 1887, c. 58,  as amended by P&SL 2001, c. 26, §1, is repealed.

Sec. 8. P&SL 1887, c. 82  is repealed.

Sec. 9. P&SL 1891, c. 67  is repealed.

Sec. 10. P&SL 1899, c. 145  is repealed.

Sec. 11. P&SL 1901, c. 362  is repealed.

Sec. 12. P&SL 1903, c. 267  is repealed.

Sec. 13. P&SL 1905, c. 216  is repealed.

Sec. 14. P&SL 1907, c. 229  is repealed.

Sec. 15. P&SL 1927, c. 15,  as amended by P&SL 1961, c. 76, is repealed.

Sec. 16. Transition; assessors in office. Assessors of the Buckfield Village Corporation in office on the effective date of this Act may continue in office for the remainder of their terms. When the term of office of an assessor expires, that assessor's successor trustee must be elected in accordance with this Act.

This bill amends the charter of the Buckfield Village Corporation by amending the corporation’s territory, changing how the corporation is managed from a board of assessors to trustees and giving the corporation the authority to operate as a water district. The bill also repeals charters that give the corporation conflicting powers and duties.
