Resolve, To Establish a Pilot Project To Issue Conditional Titles for Certain Automobiles and Trucks That Are More than 25 Years Old

Sec. 1. Pilot project. Resolved: That the Secretary of State shall establish a pilot project under which, upon the presentation of documented and notarized evidence of ownership, the Secretary of State may issue a conditional title to a Maine resident owner of an automobile or a truck that was manufactured in or after model year 1916 and is more than 25 years old. The Secretary of State shall develop a procedure whereby the owner of an automobile or truck that is issued a conditional title under this section may convert the conditional title to a certificate of title for an antique auto under the Maine Revised Statutes, Title 29-A, chapter 7 upon certification of that automobile or truck as meeting the definition of "antique auto" set forth in Title 29-A, section 101, subsection 3. In developing this procedure, the Secretary of State may require that the certification be conducted by an independent organization that specializes in antique automobiles and vehicles. The Secretary of State may establish application procedures, develop forms, set fees and establish other administrative requirements necessary to conduct the pilot project; and be it further

Sec. 2. Report. Resolved: That the Secretary of State shall submit a report to the Joint Standing Committee on Transportation no later than February 1, 2010. The report must include the status of the pilot project under section 1 and recommendations for continuance, discontinuance or modification of the pilot project's terms. After reviewing the report, the Joint Standing Committee on Transportation may report out legislation to the Second Regular Session of the 124th Legislature concerning the subject matter of this resolve.

This resolve directs the Secretary of State to establish a pilot project under which a conditional title may be issued to a Maine resident owner of an automobile or a truck that is more than 25 years old. Under the pilot project, the owner of a vehicle may convert the conditional title to a certificate of title for an antique auto upon certification that the vehicle meets the statutory definition of "antique auto." The Secretary of State is directed to submit a report on the pilot project, along with any recommendations, to the Joint Standing Committee on Transportation by February 1, 2010.
