Amend the bill by striking out everything after the enacting clause and before the summary and inserting the following:

Sec. 1. 22 MRSA §3174-LL  is enacted to read:

§ 3174-LL Dental hygienist reimbursement

1 Reimbursement.   By April 1, 2010, the department shall provide for the reimbursement under the MaineCare program of independent practice dental hygienists practicing as authorized under Title 32, section 1094-I for all procedures performed under Title 32, section 1094-Q, subsection 1. The department shall provide for MaineCare reimbursement to a federally qualified health center, pursuant to section 3174-V, when an independent practice dental hygienist is employed as a core provider at the center, or to an independent practice dental hygienist directly.

Sec. 2. Rulemaking. By April 1, 2010, the Department of Health and Human Services shall adopt routine technical rules to implement the Maine Revised Statutes, Title 22, section 3174-LL. The rules must include provisions that define an independent practice dental hygienist as a core provider when employed at a federally qualified health center.

Sec. 3. Appropriations and allocations. The following appropriations and allocations are made.

Initiative: Appropriates and allocates funds for the costs of reimbursing federally qualified health centers for services provided by employed dental hygienists practicing independently.

This amendment allows federally qualified health centers to employ independent practice dental hygienists as core providers under MaineCare rules and provides for the reimbursement of federally qualified health centers for these services.
