| | | An Act To Amend the Laws Relating to Motorized Scooters, |

| | | Motor-driven Cycles and Mopeds |
|
| | | Emergency preamble. Whereas, acts of the Legislature do not become | | effective until 90 days after adjournment unless enacted as | | emergencies; and |
|
| | | Whereas, there has been a drastic increase in the number of | | motorized cycles and off-road vehicles; and |
|
| | | Whereas, the law regarding these motorized cycles and off-road | | vehicles is not clear; and |
|
| | | Whereas, in the judgment of the Legislature, these facts create | | an emergency within the meaning of the Constitution of Maine and | | require the following legislation as immediately necessary for | | the preservation of the public peace, health and safety; now, | | therefore, |

| | | Be it enacted by the People of the State of Maine as follows: |

| | | Sec. 1. 29-A MRSA §101, sub-§36, as amended by PL 2001, c. 687, §4, is | | repealed and the following enacted in its place: |
|
| | | 36.__Moped.__"Moped" means a motorized device designed to | | travel with only 2 or 3 10-inch or larger diameter wheels in | | contact with the ground and that: |

| | | A.__May have fully operative pedals for propulsion by human | | power; |
