Sec. 1. 12 MRSA §6701-A is enacted to read:

§6701-A.__Scallop spat license

1.__License required.__A person may not engage in the activities authorized under this section without a current scallop spat license or other license issued under this Part authorizing the activities.

2.__Licensed activities. The holder of a scallop spat license may harvest, possess, ship, transport or sell scallop spat.__ Notwithstanding section 6721-A, a person who holds a valid scallop spat license may possess, ship or transport undersize scallops raised from scallop spat harvested pursuant to this permit.

3.__Fee.__The fee for a scallop spat license is $111.

4.__Violation.__A person who violates this section commits a civil violation for which a forfeiture of not less than $100 nor more than $500 may be adjudged.

SUMMARY

This bill creates a scallop spat harvesting license that allows the licensee to harvest, possess, ship, transport or sell scallop spat. The bill also permits a licensee to possess undersize scallops raised from scallop spat harvested pursuant to a scallop spat license.
