Sec. 1. 32 MRSA c. 135 is enacted to read:

INTERNET AUCTION LISTING SERVICES

§15301.__Definitions

As used in this chapter, unless the context otherwise indicates, the following terms have the following meanings.

1.__Bid.__"Bid" means an offer to buy.

2.__Commissioner.__"Commissioner" means the Commissioner of Professional and Financial Regulation.

3.__Interactive computer service.__"Interactive computer service" means an information service or system that provides or enables computer access by multiple users to a computer server, including a service or system that provides access to the Internet.

4.__Internet auction listing service.__"Internet auction listing service" means a publicly accessible site on the Internet or other interactive computer service that is designed to allow, or is advertised as a means of allowing, users to offer personal property or services for sale or lease to a prospective buyer or lessee through an on-line bid submission process and that does not examine, set the price of or prepare the description of the personal property or service to be offered or in any way use the services of a natural person as an auctioneer.

5.__Office.__ "Office" means the Department of Professional and Financial Regulation, Office of Licensing and Registration.

§15302.__Registration required

It is unlawful for a person to provide an Internet auction listing service in this State for compensation without being registered with the office, if:

1.__Located in this State.__The person is located or maintains an office in this State;

2.__User located in this State.__A seller, purchaser, lessor or lessee, or prospective seller, purchaser, lessor or lessee, of personal property or a service offered through the Internet auction listing service is located in this State; or
