G.__Boating access sites.

2.__Additional funding.__The appropriation of certain additional funds are governed by the following.

A.__Appropriations to the Department-wide Inland Fisheries and Wildlife program in the department for costs that are associated with search and rescue may not be considered amounts appropriated to the department under the Constitution of Maine, Article IX, Section 22.__The liability of the General Fund for search and rescue costs is limited to the amount appropriated.

B.__General Fund appropriations to the Fiscal Stability Program under subsection 9 may not be considered to be amounts appropriated to the department under the Constitution of Maine, Article IX, Section 22.

3.__Revenues.__Actual revenues received in excess of that estimated and allocated by the Legislature may not be expended without allocation by the Legislature, except that excess federal revenues received are subject to the expenditure provisions of Title 5, section 1669.

4.__Unencumbered balances.__Any unencumbered allocated balances, including existing balances, must be carried forward into the next fiscal year and may not be expended without allocation by the Legislature, except as provided in this section.__Unencumbered balances in the boating access sites account are nonlapsing and must be carried forward to be used for the same purpose.

5.__Nonlapsing appropriations.__General Fund appropriations to the department may not lapse but must be carried forward in a separate General Fund program to be used by the department for the purposes described in section 10801, subsection 5.__ The department, pursuant to the Constitution of Maine, Article IX, Section 22, shall seek legislatively authorized transfers from this program to meet the various costs associated with the department's other programs.

6.__Savings fund; offset against future fee increases.__A savings fund, referred to in this subsection as the "fund," is established in the department.__Appropriations to the fund are considered funds appropriated to the department under the meaning of the Constitution of Maine, Article IX, Section 22.__Money appropriated to the fund does not lapse but must be carried
