| | | §15357.__Examinations for certifications |

| | | The board shall establish and administer, or contract out to | | a recognized 3rd-party certifier for, examinations as required | | for certification under this chapter and determine | | satisfactory performance for these examinations. |

| | | §15358.__Revoking or suspending certifications |
|
| | | In accordance with the Maine Administrative Procedure Act, | | the board may revoke or suspend a certification or reprimand a | | certification holder for any violation of this chapter or | | rules of the board.__Grounds for suspension or revocation of a | | certification due to suspected incompetence or willful | | violation by a certification holder may be determined through | | retesting procedures. |

| | | §15359.__Reinstating certifications |

| | | The board shall establish a procedure for reinstating any | | certification that has been revoked or suspended.__Any person | | whose certification has been revoked may not apply for | | reinstatement of that certification before the expiration of | | one year from the date of such revocation.__If the board | | proposes to refuse a person's application for licensure or to | | suspend or revoke a person's certification, the person is | | entitled to notice and a hearing before the board. |

| | | The board shall issue a certification to any person who: |
|
| | | 1.__Qualifications.__Meets the qualifications and | | requirements for a specific certification under this chapter; |
|
| | | 2.__Application.__Completes and affirms before a notary | | public an application for examination and certification | | established by the board; |
|
| | | 3.__Evidence of qualifications.__Presents competent | | evidence, in a form acceptable to the board, demonstrating | | that the applicant meets the qualifications and requirements | | of the certification for which the applicant has applied; |
