| | | Sec. 1. Rulemaking. Resolved: That, by July 1, 2004, the | | Department of Human Services shall adopt rules regarding home | | day care providers and summer camps. Rules adopted pursuant | | to this resolve are major substantive rules as defined in the | | Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A. | | The rules must include the following provisions. |

| | | 1. For home day care providers the number of children who | | may be cared for must equal the number of children the | | provider is licensed to care for even if one child is an | | infant. |

| | | 2. For home day care providers the number of children who | | may be cared for may exceed the number of children the | | provider is licensed to care for by 4 during times of shift | | changes and unexpected events, such as unscheduled school | | closings, for a time period of up to 150 consecutive minutes | | at any one time. |

| | | 3. The rules for summer camps must be identical to the | | rules for home day care providers. |

| | | This resolve directs the Department of Human Services to | | adopt rules regarding home day care providers and summer | | camps. The rules are major substantive rules. The rules must | | change the treatment of infants in the staffing ratios, allow | | more flexibility in times of shift changes and other | | unexpected events and make summer camp rules the same as home | | day care rules. |
