Sec. 1. 34-A MRSA §3031, sub-§2-A is enacted to read:

2-A.__Prescription medication.__A physician of the department may not countermand a prescription previously prescribed for a client with mental disabilities or mental illness without first consulting with the physician who prescribed the medication unless an emergency does not allow time for consultation.__In the case of an emergency, the department's physician shall contact the physician who previously prescribed the prescription as soon as possible after the emergency had passed.

SUMMARY

This bill prohibits a physician for the Department of Corrections from countermanding a prescription previously prescribed for a client with mental disabilities or mental illness without first consulting the physician who prescribed the medication unless there is an emergency.
