Sec. K-1. Review of statewide administrative hearing functions to improve efficiency and cost-effectiveness. The Commissioner of Administrative and Financial Services shall review the current organizational structure of administrative hearings units and the proceedings conducted by those units to improve organizational efficiency and cost effectiveness, including but not limited to adjudicatory proceedings conducted pursuant to the Maine Revised Statutes, Title 5, chapter 375, subchapter 4; workers' compensation proceedings conducted pursuant to Title 39-A, chapter 7, subchapter 1; other due process hearings; and licensing disciplinary proceedings. At least 15 days before implementing any change proposed as a result of the review, the commissioner shall report the findings of the review and proposed changes to the joint standing committee of the Legislature having jurisdiction over appropriations and financial affairs and to the joint standing committee or committees of the Legislature having jurisdiction over departments affected by the proposed changes. The commissioner shall inform the State Budget Officer of the amount of savings from the improvements identified and implemented as a result of the review. Notwithstanding any other provision of law, the State Budget Officer shall transfer position counts and available balances by financial order upon approval of the Governor in order to achieve the savings in section 2 that are attributable to this section. These transfers are considered adjustments to authorized position count, appropriations and allocations in fiscal year 2006-07.
