An Act to Protect and Enhance the United States Naval Shipyard in Kittery, Maine

Be it enacted by the People of the State of Maine as follows:

     Sec. 1. United States Naval Shipyard defense diversification project. The Southern Maine Economic Development District shall study, in coordination with the Department of Economic and Community Development, the federal Economic Development Administration, the Town of Kittery, the Market Development Center, the Maine Science and Technology Foundation and the Maine Manufacturing Extension Partnership, the feasibility of using the facilities and technology available at the United States Naval Shipyard in Kittery, Maine. The purpose of the study is to evaluate the facilities at the shipyard and their potential for use by private sector industries for nondefense-related projects. Based on the study, the Southern Maine Economic Development District and the others involved in the study shall develop a targeted marketing program aimed at Maine industries, including the development of materials that highlight both the resources of the shipyard and the Town of Kittery as a place to do business.

     Sec. 2. Funds revert to General Fund. Funds appropriated pursuant to this Act to the Department of Economic and Community Development revert to the General Fund if the Southern Maine Economic Development District does not receive the anticipated federal Economic Development Administration grant.

     Sec. 3. Plan for use of funds. The Southern Maine Economic Development District must submit a detailed plan to the Department of Economic and Community Development for the use of any funds appropriated pursuant to this Act. The Department of Economic and Community Development is responsible for the oversight and approval of this plan.

     Sec. 4. Appropriation. The following funds are appropriated from the General Fund to carry out the purposes of this Act.

2000-01

ECONOMIC AND COMMUNITY DEVELOPMENT, DEPARTMENT OF
Administration - Economic and Community Development

Provides a one-time appropriation to the Department of Economic and Community Development for the Southern Maine Economic Development District. This appropriation will match a grant from the federal Economic Development Administration for a defense diversification project at the United States Naval Shipyard in Kittery, Maine, including an evaluation of the assets of the shipyard and the development of materials that promote the assets of the shipyard and the Town of Kittery, pursuant to section 1 of this Act. These funds may not be expended unless matched by at least an equal amount from the federal Economic Development Administration.

     Sec. 5. Appropriation. The following funds are appropriated from the General Fund to carry out the purposes of this Act.

ATTORNEY GENERAL, DEPARTMENT OF THE
Attorney General - Contingent

Provides funds to the Department of the Attorney General to be used to meet legal costs related to legal proceedings concerning the location of the United States Naval Shipyard in Kittery, Maine. Unexpended funds do not lapse but carry forward to the next fiscal year. The Attorney General shall provide a report to the joint standing committee of the Legislature having jurisdiction over appropriations and financial affairs no later than December 31, 2000 and every December 31st thereafter concerning expenses incurred in this program.
