An Act to Amend the North Yarmouth-Cumberland Town Line

Mandate preamble. This measure requires one or more local units of government to expand or modify activities so as to necessitate additional expenditures from local revenues but does not provide funding for at least 90% of those expenditures. Pursuant to the Constitution of Maine, Article IX, Section 21, two thirds of all of the members elected to each House have determined it necessary to enact this measure.

     Emergency preamble. Whereas, Acts of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and

     Whereas, it is the desire of the Town of Cumberland and the Town of North Yarmouth to correct inconsistencies in their common boundary; and

     Whereas, the statewide assessing date of property in the State is April 1st; and

     Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,

Be it enacted by the People of the State of Maine as follows:

     Sec. 1. Boundary line between Town of Cumberland and Town of North Yarmouth. The boundary line between the Town of Cumberland and the Town of North Yarmouth, both located in the County of Cumberland, is as follows.

     Beginning at a stone marker on the northeasterly sideline of the road known as Greely Road Extension, the town line between the Town of North Yarmouth and the Town of Cumberland runs along the northeasterly sideline of the Greely Road Extension and Greely Road rights-of-way along this course:

     From above-mentioned stone post bearing the marks "C" and "NY," thence S37_ 44' 52" E a distance of 68.75 feet; thence along the same course a distance of 50.00 feet; thence S37_ 10' 17" E a distance of 1,416.60 feet to a point; thence S37_ 52' 40" E a distance of 827.71 feet to a stone monument, all of the above distances being along the northeasterly sideline of Greely Road Extension and Greely Road; thence, referencing the plan of "Westridge Subdivision" as recorded in the Cumberland County Registry of Deeds Plan Book #183, page #59, N47_ 30' 24" E a distance of 377.35 feet to a 4"x 4" granite monument; thence N18_ 09' 26" E a distance of 556.43 feet; thence S37_ 59' 14" E a distance of 115.00 feet; thence N18_ 09' 26" E a distance of 93.71 feet; thence S71_ 50' 34" E a distance of 49.50 feet; thence N56_ 50' 13" E a distance of 290.00 feet; thence S86_ 26' 39" E a distance of 222.16 feet to the northerly sideline of Shady Run Lane; thence along said Shady Run Lane along a curve to the right with a radius of 219.82 feet a distance of 203.71 feet; thence continuing along said Shady Run Lane along a curve to the left with a radius of 25.00 feet, a distance of 25.41 feet; thence continuing along said Shady Run Lane along a curve to the right with a radius of 70.00 feet, a distance of 71.16 feet; thence N56_ 50' 43" E a distance of 265.12 feet to a granite monument; thence S25_ E a distance of 1,900 feet, more or less, to the westerly sideline of Doughty Road; thence S22_ 5' 30" W a distance of 619.65 feet; thence S22_ 5' 30" W a distance of 795.00 feet, more or less, to the northeasterly sideline of Greely Road; thence S37_ 52' 40" E a distance of 1,535.00 feet, more or less, to a granite monument.

     Sec. 2. Maintain sewer lines. The correcting of the boundary line between the Town of Cumberland and the Town of North Yarmouth affects lots served by Cumberland's municipal sewer system. Shady Run Lane, Greely Road and Greely Road Extension are served by Cumberland's municipal sewer system and the Treasurer of the Town of Cumberland is authorized to file, record and perfect sewer liens on properties within the Town of North Yarmouth that are served by Cumberland's municipal sewer system.

     Emergency clause. In view of the emergency cited in the preamble, this Act takes effect when approved.

Effective April 14, 1997.
