§1322. Civil liability for willful noncompliance

Any consumer reporting agency or user of information which willfully and knowingly fails to comply with any requirement imposed under this chapter with respect to any consumer is liable to that consumer in an amount equal to the sum of: [1977, c. 514, (NEW).]

1. Actual damages.  Any actual damages sustained by the consumer as a result of the failure;

2. Treble damages.  In addition to actual damages, there shall be assessed against the willful violator a sum of 3 times such actual damages.

3. Costs of attorney's fees.  In the case of any successful action to enforce any liability under this section, the costs of the action together with reasonable attorney's fees as determined by the court.
