The required local activities in this bill may represent a state mandate pursuant to the Constitution of Maine. If the bill does require a local unit of government to expand or modify its activities so as to necessitate additional expenditures from local revenue, the state mandate provisions of the Constitution of Maine require either: (1) General Fund appropriations be provided to fund at least 90% of any additional necessitated local costs of the mandate; or (2) a Mandate Preamble be added to the bill and two-thirds of the members of each House vote to exempt the mandate from the funding requirement. If the bill does represent a state mandate and neither one of these actions occurs, the local units of government will not be required to implement the mandated activities.
Fiscal Detail and Notes
This bill includes ongoing General Fund appropriations of $564,059 in fiscal year 2023-24 and $272,999 in fiscal year 2024-25 to a newly created Menstrual Products Reimbursement program within the Department of Education to reimburse school administrative units that serve students in grades 6 to 12 for 90% of the cost of making menstrual products available to students at no cost in all school bathrooms. Of that amount, $291,060 is one-time funding in fiscal year 2023-24 for the cost of purchasing and installing coinless dispensers in bathrooms and $272,999 is ongoing funding beginning in fiscal year 2023-24 for the cost of menstrual products. 
According to the most recent data provided by the Department of Education, there are approximately 94,879 students in grades 6 through 12 and approximately 44.44% are female.  This estimate assumes an average price of 0.22 cents per menstrual product and that female students will use an average of 3 menstrual products per month during the approximately 10 months of a school year. This estimate also assumes the cost for a coinless dispenser is $308 and that half of the estimated 300 school buildings that serve students in grades 6 through 12 will have dispensers installed while the other half will provide an alternative container to hold the menstrual products.  It is assumed that there are 7 bathrooms per school building for a total of 2,100 bathrooms that will need to be supplied with menstrual products.
