Fiscal Detail and Notes
The bill allows for a private party gun sale to be facilitated by a federally licensed firearms dealer or through a law enforcement background check. Firearms background checks are performed by dealers through the FBI's National Instant Criminal Background Check system (NICS). According to the Department of Public Safety, the use of NICS is not allowed for this purpose, therefore the department would be precluded from complying with this bill under federal regulations. It is unclear what the federal ramifications would be for noncompliance with federal NICS use.
