Amend the amendment by inserting after the title the following:

Amend the bill by striking out all of section 1.

Amend the bill in section 7 in §19132 by striking out all of subsection 2 (page 2, lines 3 to 5 in L.D.) and inserting the following:

2. Subcommittees.  Appoint subcommittees, which may include members from any public or private agency, advisory committee or any citizen, who has appropriate interest and expertise, as may be necessary to carry out the work of the cabinet;

Amend the amendment by striking out all of subsection 3 (page 1, lines 13 to 34 and page 2, lines 1 to 13 in amendment) and inserting the following:

3 Membership.   The council consists of the members listed in this subsection, who must have a strong interest in early childhood and early care and education and must be influential in their communities:
A Two members of the Senate, one from each of the 2 political parties having the greatest number of members in the Senate, appointed by the President of the Senate;
B Two members of the House of Representatives, one from each of the 2 political parties having the greatest number of members in the House, appointed by the Speaker of the House;
C The Governor or the Governor's designee;
D One person who is the parent of a young child, appointed by the Speaker of the House;
E Two persons with experience in public funding and philanthropy, appointed by the Governor;
F One person representing child abuse and neglect prevention, appointed by the President of the Senate;
G One person representing postsecondary education, appointed by the Governor;
H Two persons representing statewide, membership or constituent organizations that advance the well-being of young children and their families, including early care and education programs, Head Start programs, resource development centers, child development services, physicians and child advocates, nominated by their organizations and appointed by the cabinet;
I Three persons representing public or private family child care providers, child care centers or programs for school-age children, appointed by the Governor;
J One person representing a business roundtable on early childhood investment, appointed by the Governor;
K One person with expertise in children's health or public health, appointed by the Governor;
L Two ex officio nonvoting members who are employees of the Department of Education and direct or work in programming that affects young children, appointed by the Commissioner of Education;
M Two ex officio nonvoting members who are employees of the Department of Health and Human Services and direct or work in programming that affects young children, appointed by the Commissioner of Health and Human Services; and
N One person appointed by the Child Care Advisory Council established by section 12004-I, subsection 35-B.

Amend the amendment on page 2 by inserting after section 14 the following:

Amend the bill by striking out all of sections 15 and 16 and inserting the following:

Sec. 15. 22 MRSA §3739, sub-§6,  as amended by PL 2011, c. 388, §13, is further amended to read:

6. Report.  By January 15th, the council shall submit an annual report to the commissioner, the cochairs chair of the Maine Children's Growth Council Cabinet Early Childhood Advisory Council established in Title 5, chapter 621 623 and the joint standing committee of the Legislature having jurisdiction over human services matters. The report must describe the council's activities for the year regarding its duties specified in subsection 5 and must outline policy changes recommended by the council, along with necessary implementing legislation.

Amend the amendment by striking out all of section 17 and inserting the following:

Sec. 17. Appropriations and allocations. The following appropriations and allocations are made.

summary

This amendment:

1. Restores the Child Care Advisory Council, which is eliminated in the bill;

2. Restores the Children's Cabinet's duty to appoint subcommittees, which is eliminated in the bill;

3. Makes changes to the composition of the Maine Children's Cabinet Early Childhood Advisory Council, including requiring the appointment of 2 persons, rather than 3, representing organizations that advance the well-being of children; requiring the appointment of 3 persons, rather than 2, representing child care providers; and requiring the appointment of one person appointed by the Child Care Advisory Council; and

4. Restores the Child Care Advisory Council as the entity that must be consulted by the Department of Health and Human Services when it applies for federal funds under the laws governing child care services or when submitting state plans, amendments to state plans or waivers for federal approval.
