An Act To Allow Workplace Substance Use Testing for Fentanyl, Hydromorphone, Hydrocodone, Oxycodone and Oxymorphone Use at the Employer's Discretion

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 26 MRSA §691  is enacted to read:

§ 691 Testing for fentanyl, hydromorphone, hydrocodone, oxycodone and oxymorphone

Notwithstanding any other provision of law, an employer may test an employee or an applicant for employment for fentanyl, hydromorphone, hydrocodone, oxycodone and oxymorphone use during any substance use test administered by the employer.

SUMMARY

This bill allows an employer to test an employee or an applicant for employment for fentanyl, hydromorphone, hydrocodone, oxycodone and oxymorphone use during any substance use test administered by the employer.
