An Act To Establish the Statute of Limitations in Product Liability Cases

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 14 MRSA §872  is enacted to read:

§ 872 Product liability actions

Notwithstanding section 859 and Title 18-C, section 2-807, an action involving product liability must be commenced within 15 years after the cause of action accrues. For purposes of this section, "product liability" has the same meaning as in Title 24-A, section 6093, subsection 9.

Sec. 2. Application. This Act applies to all product liability claims that arose within 15 years prior to the effective date of this Act and all product liability claims subsequent to the effective date of this Act.

SUMMARY

This bill extends the statute of limitations for product liability actions from 6 to 15 years.
