An Act To Create Uniform Practices for Medicare Beneficiaries in Small Group Plans

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 24-A MRSA §2844, sub-§4  is enacted to read:

4 Groups with fewer than 20 employees; coordination with Medicare.   Notwithstanding subsection 1-A and any provision of federal law or regulation, an insurer that provides health care coverage to a group with fewer than 20 employees is the primary insurer for the payment of benefits to or on behalf of any insured under the group contract who is eligible for Medicare Part B coverage without regard to whether the insured is enrolled in Medicare Part B and Medicare Part B is the secondary insurer.

This bill requires an insurer that provides health care coverage to a group with fewer than 20 employees to be the primary insurer for the payment of benefits to or on behalf of any insured under the group contract who is eligible for Medicare Part B coverage.
