Amend the bill by striking out the title and substituting the following:

‘An Act To Provide for Municipalities To Allow Grocery Stores of More than 5,000 Square Feet and up to 10,000 Square Feet To Open on Thanksgiving, Easter and Christmas’

Amend the bill by striking out all of the emergency preamble (page 1, lines 1 to 8 in L.D.).

Amend the bill in section 1 in subsection 2 in paragraph GG in the last line (page 2, line 18 in L.D.) by striking out the following: "; and" and inserting the following: '; and'

Amend the bill in section 1 in subsection 2 by striking out all of paragraph HH (page 2, lines 19 to 28 in L.D.) and inserting the following:

HH. Stores with more than 5,000 square feet of interior customer selling space that engage in retail sales and that do not require, as a condition of employment, that their employees work on Sundays. If an employer decreases the average weekly work hours of an employee who has declined to work on Sundays, it is prima facie evidence that the employer has required Sunday work as a condition of employment in violation of this section, unless the employer and employee agreed that the employee would work on Sundays when the employee was initially hired. In no event, however, may any Except as provided in paragraph II, a store having more than 5,000 square feet of interior customer selling space may not be open on Easter Day, Thanksgiving Day and or Christmas Day . ; and
II Grocery stores with more than 5,000 square feet but no more than 10,000 square feet of interior customer selling space may be open on Easter Day, Thanksgiving Day and Christmas Day if the requirements of section 3210 are met. For purposes of this paragraph, "grocery store" has the same meaning as in Title 22, section 2491, subsection 7-B.

Amend the bill in section 1 in subsection 2 by striking out all of the last paragraph (page 2, lines 29 to 31 in L.D.) and inserting the following:

‘This subsection does not exempt the businesses or facilities specified in sections 3205 and 3207 from closing in any municipality until the requirements of those sections have been met.’

Amend the bill in section 2 in §3210 in the first paragraph in the first line (page 2, line 34 in L.D.) by inserting after the following: " with" the following: ' more than 5,000 square feet but'

Amend the bill in section 2 in §3210 in the first paragraph in the 3rd line (page 2, line 36 in L.D.) by striking out the following: " subsection" and inserting the following: ' section'

Amend the bill by striking out all of the emergency clause.

Amend the bill by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

This amendment places a threshold of 5,000 square feet on a grocery store that may be open on Easter, Thanksgiving or Christmas, if approved by the municipality, and removes the emergency preamble and emergency clause.
