Amend the bill by inserting after section 3 the following:

Sec. 4. 32 MRSA §18302, sub-§34,  as enacted by PL 2015, c. 429, §21, is repealed.

Sec. 5. 32 MRSA §18304, sub-§2, ¶H,  as enacted by PL 2015, c. 429, §21, is amended to read:

H. Employ a an unlicensed person as a dental hygienist, independent practice dental hygienist, denturist or dental radiographer who is not licensed to practice to provide services for which a license is required by this chapter.’

Amend the bill in section 4 in paragraph J in the first line (page 1, line 22 in L.D.) by inserting after the following: "enrolled in a" the following: ' dental assisting program or a'

Amend the bill in section 15 in subsection 1 in the 5th line (page 6, line 12 in L.D.) by striking out the following: "reversible intraoral procedures" and inserting the following: ' reversible intraoral procedures activities'

Amend the bill by inserting after section 22 the following:

Sec. 23. Charitable dentist licenses and clinical dentist educator licenses; expiration date. A charitable dentist license and a clinical dentist educator license issued by the Board of Dental Practice and in effect on the effective date of this Act remain in effect and authorize the license holder to practice until the date of expiration specified in the license.’

Amend the bill by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

SUMMARY

This amendment authorizes a student enrolled in a dental assisting program to practice under the supervision of the student's instructors without first obtaining a license from the Board of Dental Practice. The amendment also removes an unnecessary definition and clarifies that the crime of unlawful practice applies whenever a person employs an unlicensed person to provide services for which a license is required by the Dental Practice Act.

The bill eliminates the charitable dentist license and clinical dentist educator license categories. The amendment clarifies that a charitable dentist license and a clinical dentist educator license issued by the Board of Dental Practice and in effect on the effective date of this legislation remain in effect until the date of expiration specified in the license.
