Amend the bill in section 1 in subsection 1 by striking out all of the first blocked paragraph (page 1, lines 14 and 15 in L.D.) and inserting the following:

‘The 5 members must be residents of the State and appointed from the public. A person may not be appointed who is currently or has previously been a Legislator or a legislative employee at the time of appointment.’

Amend the bill in section 2 in subsection 2 in the first 2 lines (page 1, lines 23 and 24 in L.D.) by striking out the following: "The commission must issue its first report no later than April 15, 1999. No Beginning October 1, 2017, no" and inserting the following: ' The commission must issue its first report no later than April 15, 1999. No'

Amend the bill in section 2 in subsection 2 in paragraph B in subparagraph (1-B) in the last line (page 2, line 7 in L.D.) by striking out the following: " ;" and inserting the following: ' . Nothing in this subparagraph prevents the judicial branch from making recommendations to the Governor or Legislature for compensation for justices and judges, including, but not limited to, recommendations made by the Chief Justice of the Supreme Judicial Court in preparing the budget of the judicial branch as required by Title 4, section 1; and'

Amend the bill in section 2 in subsection 2 in paragraph B in subparagraph (1-C) in the last line (page 2, line 13 in L.D.) by striking out the following: " leadership; and" and inserting the following: ' leadership;'

Amend the bill in section 2 in subsection 2 in paragraph B by striking out all of subparagraph (2) (page 2, lines 14 to 17 in L.D.) and inserting the following:

(2) Compensation for the Attorney General, the Secretary of State, the Treasurer of State and the State Auditor;

SUMMARY

This amendment does the following:

1. It specifies that no current or former Legislators or legislative staff may be appointed to the State Compensation Commission. The bill prohibits only current Legislators from such appointments;

2. It clarifies that the work of the commission does not prevent the Chief Justice and other judicial staff from making recommendations regarding judicial compensation; and

3. It removes from the duties of the commission making recommendations for compensation of the Attorney General, Secretary of State, Treasurer of State and State Auditor.
