An Act To Allow Municipalities To Prohibit Retail Marijuana Facilities in Safe Zones

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 7 MRSA §2449, sub-§1,  as enacted by IB 2015, c. 5, §1, is amended to read:

1. Municipality may regulate retail marijuana establishments and retail marijuana social clubs.   A municipality may regulate the location and operation of retail marijuana establishments and retail marijuana social clubs pursuant to Title 30-A, chapter 187, subchapter 3. A municipality may adopt an ordinance that prohibits the location of retail marijuana establishments and retail marijuana social clubs within a safe zone designated by the municipality in accordance with Title 30-A, section 3253. A municipality may adopt and enforce regulations for retail marijuana establishments and retail marijuana social clubs that are at least as restrictive as the provisions of this chapter and any rule adopted pursuant to this chapter. Nothing in this chapter prohibits the registered voters of a municipality from calling for a vote on any regulations adopted by a municipal legislative body.

Sec. 2. 30-A MRSA §3015  is enacted to read:

§ 3015 Ordinances regarding retail marijuana establishments and retail marijuana social clubs

As provided under Title 7, section 2449, a municipality may adopt an ordinance that prohibits the location of retail marijuana establishments and retail marijuana social clubs within a safe zone designated by the municipality under section 3253.

This bill allows municipalities to adopt ordinances prohibiting the location of retail marijuana establishments and retail marijuana social clubs under the Marijuana Legalization Act.
