Amend the bill by striking out the title and substituting the following:

‘An Act To Allow Hunting of Migratory Game Birds on Sundays and Prohibit Hunting of Migratory Game Birds on Wednesdays’

Amend the bill by striking out everything after the enacting clause and before the summary and inserting the following:

Sec. 1. 12 MRSA §11205, sub-§1, ¶A,  as enacted by PL 2003, c. 414, Pt. A, §2 and affected by c. 614, §9, is amended to read:

A. Hunt wild animals or wild birds on Sunday , except that a person may hunt migratory game birds other than the American woodcock in accordance with this Part as long as any hunting on agricultural land is with the landowner’s permission; or

Sec. 2. 12 MRSA §11205-A  is enacted to read:

§ 11205-A Hunting migratory birds on Wednesday

1 Prohibition.   A person may not:
A Hunt migratory game birds on Wednesday; or
B Possess any migratory game bird taken in violation of paragraph A except as otherwise provided in this Part.
2 Penalties.   A person who violates subsection 1 commits a Class E crime.

SUMMARY

This amendment replaces the bill. The bill allows hunting of migratory game birds on Sundays. The amendment allows hunting of migratory game birds, except the American woodcock, on Sundays. The amendment prohibits hunting migratory game birds on Sundays from agricultural land except with the landowner's permission. The amendment prohibits hunting migratory game birds on Wednesdays and possession of a migratory game bird that was hunted on a Wednesday. The amendment provides that a person who hunts migratory game birds on a Wednesday or possesses a migratory game bird that was hunted on a Wednesday commits a Class E crime.
