An Act To Amend the Exemption for Highway Contractors and Subcontractors under the Arborist Licensing Laws

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 7 MRSA §2174, sub-§5,  as enacted by PL 1999, c. 84, §3, is amended to read:

5. Others.   Highway contractors, subcontractors and their employees who remove remain on the ground while removing trees during the performance of contracts for the construction or maintenance of highways and general contractors who remove interfering shade or ornamental trees or interfering parts of shade or ornamental trees in the conduct of their regular business.

SUMMARY

Currently, highway contractors and subcontractors who remove trees during the performance of contracts for the construction or maintenance of highways are exempt from the laws governing arborists. This bill provides that those contractors and subcontractors must remain on the ground when removing trees to be exempt from those laws.
