Amend the amendment in Part I in section 1 in the 2nd line (page 14, line 38 in amendment) by striking out the following: "$44,500,000" and inserting the following: '$39,994,433'

Amend the amendment by inserting after Part I the following:

PART J

Sec. J-1. Increasing reimbursement for support services for adults with intellectual disabilities or autistic disorder. By July 1, 2016, the Department of Health and Human Services shall amend its rules in rule Chapter 101: MaineCare Benefits Manual, Chapter II, Section 29: Support Services for Adults with Intellectual Disabilities or Autistic Disorder to increase the combined annual limit for reimbursement for home support, community support, work support-individual or work support-group, assistive technology and career planning to $47,550. The department shall determine the number of hours of specific support services on the basis of the increased combined annual limit. Rules adopted pursuant to this section are routine technical rules pursuant to the Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A.

Sec. K-1. Personal needs allowance for residents of nursing facilities. By July 1, 2016, the Department of Health and Human Services shall amend the rules for the MaineCare program to increase the personal needs allowance for persons residing in nursing facilities. The rules must provide for an increase in the personal needs allowance from $40 per month to $50 per month. Rules adopted pursuant to this section are routine technical rules as defined in the Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A.

Amend the amendment by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

SUMMARY

Part J requires the Department of Health and Human Services to amend its rules to increase the combined annual limit for reimbursement for home support, community support, work support-individual or work support-group, assistive technology and career planning to $47,550. The department is required to determine the number of hours of specific support services on the basis of the increased combined annual limit.

Part K directs the Department of Health and Human Services to amend its rules to provide for increases in the personal needs allowances of residents in nursing facilities and residential care facilities. The rules are designated as routine technical rules.

This amendment provides funding for the initiatives in this amendment by reducing the amount transferred to the Maine Budget Stabilization Fund by $4,505,567 to $39,994,433.
