An Act To Improve the Maine Sex Offender Registry

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 34-A MRSA §11272, sub-§2,  as enacted by PL 2011, c. 663, §3, is amended to read:

2. Other jurisdictions.  A person who commits criminal conduct and is sentenced in another jurisdiction , except a foreign country, for that criminal conduct on or after January 1, 2013 as an adult or as a juvenile sentenced as an adult or a person who commits criminal conduct and is sentenced in a foreign country for that criminal conduct on or after January 1, 2015 as an adult or as a juvenile sentenced as an adult:
A. For an offense that requires registration in the jurisdiction of conviction pursuant to that jurisdiction's sex offender registration laws or that would have required registration had the person remained there;
B. For an offense that contains the essential elements of a Tier I offense, Tier II offense or Tier III offense; or
C. For a military, tribal or federal offense requiring registration pursuant to:

(1) The federal Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act, also known as the Jacob Wetterling Act, Section 170101 of the federal Violent Crime Control and Law Enforcement Act of 1994, Public Law 103-322, as amended; or

(2) The federal Adam Walsh Child Protection and Safety Act of 2006, Public Law 109-248, 42 United States Code, Chapter 151.

Sec. 2. 34-A MRSA §11273, sub-§6-A  is enacted to read:

6-A Foreign country.   "Foreign country" means a country, including a political subdivision thereof, other than the United States.

Sec. 3. 34-A MRSA §11273, sub-§7,  as enacted by PL 2011, c. 663, §3, is amended to read:

7. Jurisdiction.  "Jurisdiction" means the Federal Government, including the military, this State, another state or , a tribe or, beginning January 1, 2015, a foreign country.

This bill applies the requirements of the Sex Offender Registration and Notification Act of 2013 to a person who is sentenced on or after January 1, 2015 in a foreign country for an offense that, if committed in this State, would subject that person to inclusion on this State's sex offender registry.
