An Act To Amend the Laws Governing Prosecution of Individuals Possessing a Controlled Substance under Certain Circumstances

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 17-A MRSA §1107-A, sub-§6  is enacted to read:

6   Evidence derived as a result of a person's seeking medical assistance when experiencing a drug overdose or for another person who is experiencing a drug overdose is not admissible in proving a violation of this section.

This bill prohibits the admissibility of evidence derived as a result of a person's seeking medical assistance when experiencing a drug overdose or for another person who is experiencing a drug overdose in proving the crime of unlawful possession of a scheduled drug.
