An Act Regarding Certain Aspects of Infant Care in Child Care Facilities

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 22 MRSA §8309  is enacted to read:

§ 8309 Cloth diapers

A child care facility may use a cloth diaper for a child upon the request of the parent or guardian of the child. If a parent or guardian of a child requests that a child care facility use a cloth diaper for the child, the parent or guardian must provide clean diapers. A child care facility that uses a cloth diaper upon the request of a parent or guardian shall comply with diapering guidelines available from the Division of Licensing and Regulatory Services and place soiled cloth diapers in a sealed bag or container and return the soiled diapers to the parent or guardian.

This bill allows a parent or guardian to request that a child care facility use cloth diapers for the parent's or guardian's child if allowed by the child care facility.
